A. general terms (Software products)
1. Introduction

These Terms and Conditions (“Terms”) govern the purchase, licensing, and use of software products (“Software”) provided by Ingeniat Estudios y Proyectos SL (“Company”, “we”, “us”).

By purchasing, downloading, installing, or using the Software, you agree to be bound by these Terms.

2. License Grant

We grant you a non-exclusive, non-transferable, revocable license to use the Software solely for your internal business or professional purposes within the marine engineering field.

You may not:

  • Resell, sublicense, or distribute the Software

  • Reverse engineer, decompile, or modify the Software

  • Use the Software for unlawful or unauthorized purposes

3. Intended Use & Industry Disclaimer

The Software is designed to assist in marine engineering calculations, planning, or analysis. However:

  • It is not a substitute for professional engineering judgment

  • It must not be solely relied upon for safety-critical decisions

  • Users are responsible for verifying outputs before operational use

The Software is not certified for navigation, vessel control, or safety-critical systems unless explicitly stated.

4. User Responsibilities

You agree to:

  • Ensure all input data is accurate

  • Validate outputs before applying them in real-world marine environments

  • Comply with all applicable maritime laws, classification society rules, and regulatory standards

5. Payments and Pricing

  • All prices are listed in euro unless otherwise stated

  • Payments are due upfront unless otherwise agreed

  • We reserve the right to change pricing at any time (existing purchases are unaffected)

6. Updates and Support

  • Updates may be provided at our discretion

  • Support (if offered) is limited to email

  • We do not guarantee continuous updates or compatibility with all systems

7. Intellectual Property

All rights, title, and interest in the Software remain with Ingeniat Estudios y Proyectos SL

This includes:

  • Source code

  • Algorithms

  • UI/UX design

  • Documentation

8. Limitation of Liability

To the fullest extent permitted by law:

We shall not be liable for:

  • Any indirect, incidental, or consequential damages

  • Loss of profit, data, or business interruption

  • Errors leading to engineering miscalculations or operational issues

In all cases, our total liability shall not exceed the amount paid for the Software.

9. Warranty Disclaimer

The Software is provided “as is” and “as available”.

We make no warranties regarding:

  • Accuracy or completeness of results

  • Fitness for a particular marine application

  • Uninterrupted or error-free operation

10. Termination

We may terminate your license if you:

  • Breach these Terms

  • Misuse the Software

Upon termination, you must cease all use and delete all copies.

B. Refund Policy (Software Products)
1. Overview

This Refund Policy applies to all software purchases made through Ingeniat Estudios y Proyectos SL.

Due to the nature of digital products, refunds are limited and subject to the conditions below.

2. Eligibility for Refunds

You may request a refund if:

  • The Software fails to function as described, and

  • We are unable to resolve the issue within a reasonable timeframe

Refund requests must be made within 7 days of purchase

3. Non-Refundable Situations

Refunds will not be provided if:

  • You change your mind after purchase

  • The Software is incompatible with your system (unless explicitly guaranteed)

  • You lack the expertise to use the Software

  • The issue arises from incorrect data input or misuse

4. Trial Versions

If a demo or trial version is provided, you are expected to evaluate the Software before purchasing. Refunds are less likely if a trial was available.
